Merced Man Faces 26 Years to Life in Prison

On July 27, 2018, 32-year-old Bernabe Gonzalez, of Merced, was convicted of first degree murder by a Merced County jury, in connection with the September 2017 murder of 34-year-old Maria Garcia-Vargas, announced Merced County District Attorney Larry D. Morse II.

Gonzalez and Garcia-Vargas met at an orchard in Merced County in the early morning hours on September 1, 2017. After the two had a disagreement regarding the affair they were having, Gonzalez pulled out a knife and stabbed Garcia-Vargas seven times, and cut her throat. Gonzalez
then dumped her body in a nearby canal, where it was found a few hours later by a farm worker. Shortly after the murder, Gonzalez went home, packed up his house, and fled to Arizona.
Within three days investigators linked Gonzalez to the murder, he was arrested in Arizona on September 4, 2017.

“We thank the jury for their service and we are obviously satisfied with their verdict,” said Deputy District Attorney Thomas Min, who prosecuted the case.

Gonzalez will be sentenced on August 24 at 8:30 and he faces 26 years to life in prison.


CHP Press Release for Fatal Motorcycle Crash I-5 & 152

On August 1, 2018 at approximately 0439 hours, the Merced Communication Center (MCC) received a call of a grass fire on the right shoulder of Interstate 5 northbound north of State Route 152. Officers from the California Highway Patrol (CHP) Los Banos Area Office responded to the scene and determined the fire was started by a traffic collision involving a motorcycle.

During the initial investigation it was determined, an unidentified rider was riding a Kawasaki motorcycle on I-5 northbound, north of SR-152, at an undetermined speed. The rider allowed the Kawasaki to travel off of the east shoulder of I-5 causing the Kawasaki to collide with a dirt embankment and the rider was ejected from the motorcycle. As a result of the collision the rider sustained fatal injuries. The rider and the Kawasaki were not able to be identified at the scene of the collision.

This collision remains under investigation.

PALCUS, The Portuguese-American Leadership Council of the United States has released the top 101 cities in the US with people born in Portugal.

The following is some of the results from the overall list for California.

Hilmar, CA (1st) leads the way, with Fulton (7th), Artesia (23rd), Tipton (24th), Escalon (31st), Penngrove (35th), and Gustine (37th).  Los Banos came in 79th.

Merced Area CHP Reports Fatal Collision

On August 2, 2018, at approximately 1704 hours, Merced Communication Center received a call of a collision involving a solo Chevrolet pickup off the roadway on La Grange Road, north of State Route 59. Emergency personnel was requested and responded to the scene.  Officers from the California Highway Patrol (CHP) Merced Area Office responded to the scene and investigated the collision.

During the course of the investigation it was determined, Mr. Ruiz-Rosales was driving a 2006 Chevrolet Silverado southbound on La Grange Road, north of State Route 59, at a stated speed of 55 to 60 miles per hour. As Mr. Ruiz-Rosales negotiated a right-hand curve in the road,  with a recommended posted speed limit of 40 miles per hour, Mr. Ruiz-Rosales allowed the Chevrolet to drift into the opposing traffic lane.

Mr. Ruiz-Rosales turned the Chevrolet sharply to the right to avoid on-coming traffic and lost control of his vehicle. The Chevrolet traveled off the west roadway edge of La Grange Road and down a steep embankment. The Chevrolet overturned several times, colliding with several large trees. The Chevrolet came to rest on its wheels between two trees. As a result of the collision, Mr. Ruiz-Rosales sustained a minor laceration to the top of the head. The right front passenger sustained fatal injuries due to the significant intrusion to the right side of the passenger compartment. Both occupants were properly seat belted. Drugs and alcohol were not a factor in this collision.

BehindMLM: Santiago De La Rosa Settles With SEC and TelexFree Trustee

Following denial of his motion to dismiss, Santiago De La Rosa entered settlement negotiations with the SEC and TelexFree Trustee.

Those negotiations lead to a proposed settlement, which was approved by the court on July 31st.

Specific details of De La Rosa’s settlement haven’t been made public.

From court filings we know De La Rosa and his wife’s net winnings from TelexFree were calculated to be $585,731.

The SEC’s claims against De La Rosa for $1.7 million, including prejudgment interest.

As part of the approved settlement, De La Rosa will surrender balances in three bank accounts,  two in his name and one held by Magica Media Corp.

De La Rosa will also return an additional $100,000 to the Trustee.

Of the original eight individually named defendants in the SEC’s 2014 lawsuit, only Carlos Wanzeler and Faith Sloan have not settled.

Wanzeler fled the US and is a fugitive hiding out in Brazil. Sloan, through her “Cryptocurrency Queen Wiki” persona, continues to promote dubious cryptocurrency schemes on Facebook.

Los Banos CHP Report Fatal Collision

On August 5, 2018 at approximately 1804 hours, the Merced Communication Center (MCC) received a call traffic collision at the cross of Shields Avenue and Russell Avenue. Officers from the California Highway Patrol (CHP) Los Banos Area Office responded to the scene.

During the initial investigation it was determined, the driver of the Honda was driving eastbound on Shields avenue approaching Russell Avenue at an undetermined speed. Mr. Cardenas was driving a 2014 Peterbilt pulling two empty flatbed trailers southbound on Russell Avenue approaching Shields Avenue at 55 miles per hour. The driver of the Honda failed to stop at a posted stop sign at Russell Avenue and traveled into the intersection directly into the path of the Peterbilt. The front of the Peterbilt collided into the driver’s side of the Honda. Due to the collision, the driver of the Honda was pronounces deceased at the scene.

Drugs and/or Alcohol to not appear to be a factor.

Modesto Area CHP Reports Fatal Collision

On August 7, 2018, at approximately 1920 hours, the Merced Communications Center received a call of a traffic collision between two vehicles on Patterson Road west of Langworth Road. Officers from the California Highway Patrol Modesto Area Office were dispatched to the scene.

The initial investigation found that the driver of a 2000 Toyota was driving westbound on Patterson Road, west of Langworth Road, in the westbound lane, at approximately 40-45 miles per hour. Marisela Wilkinson was driving a Dodge eastbound on Patterson Road, west of Langworth Road, in the eastbound lane, at approximately 45 miles per hour towards the Toyota. As the two vehicles neared each other, The driver of the Toyota for unknown reasons crossed into the eastbound lane. The driver of the Toyota turned her vehicle to the right and re-entered the westbound lane. Then suddenly, for reasons still under investigation, the Toyota turned abruptly to the left and re-entered the eastbound lane, directly into the path of the Dodge. Ms. Wilkinson was unable to react, and the front of the Dodge collided head-on with the front of the Toyota. This impact caused the Toyota to be pushed in a southeasterly direction, off of the road. The Toyota continued to travel backwards, in a southeasterly direction, into a ditch that was full of cattle waste runoff. As the Toyota entered the ditch, it rolled over onto its driver side, submerging the left side of the Toyota. Witnesses arrived on scene and attempted to rescue the occupants of the Toyota. Due to the extent of damage to the Toyota, and its location, they were unable to do so. Fire and ambulance personnel arrived on scene and pronounced both of the occupants of the Toyota deceased. The driver and all of the passengers in the Dodge were transported by ambulance to Memorial Medical Center, in Modesto, for non-life threatening injuries. All of the occupants, in both vehicles, were wearing their seat belts.

It is unknown if alcohol and/or drugs were a contributing factor in this collision.

Modesto Area CHP to Hold DUI Checkpoint

Modesto, CA – Modesto Area of the California Highway Patrol will be conducting a DUI/Drivers License Checkpoint on August 11, 2018, in north Modesto within the unincorporated area of Stanislaus County between the hours of 8:30 P.M. and 3:00 A.M.

The deterrent effect of DUI checkpoints is a proven resource in reducing the number of persons killed and injured in alcohol or drug involved crashes. Research shows that crashes involving an impaired driver can be reduced by up to 20 percent when well-publicized DUI checkpoints and proactive DUI patrols are conducted routinely.

In California, this deadly crime led to 1,145 deaths in 2014 because someone failed to designate a sober driver. That same year, another 23,878 people were injured statewide under similar circumstances. Nationally, the latest data shows nearly 10,000 were killed by an impaired driver. Officers will be looking for signs of alcohol and/or drug impairment with officers checking drivers for proper licensing delaying motorists only momentarily. When possible, specially trained officers will be available to evaluate those suspected of drug-impaired driving. Recent statistics reveal 30 percent of drivers in fatal crashes had one or more drug in their systems. According to the National Highway Traffic Safety Administration (NHTSA), checkpoints have provided the most effective documented results of any of the DUI enforcement strategies. Nearly 90 percent of California drivers approve of DUI checkpoints.

DUI Checkpoints are placed in locations based on collision statistics and frequency of DUI arrests affording the greatest opportunity for achieving drunk and drugged driving deterrence. Locations are chosen with safety considerations for the officers and the public. Drivers caught driving impaired can expect the impact of a DUI arrest to include jail time, fines, fees, DUI classes, other expenses that can exceed $15,000 not to mention the embarrassment when friends and family find out.

Funding for this checkpoint is provided to the California Highway Patrol by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration, reminding everyone to ‘Report Drunk Driver – Call 9-1-1’.

John Cates Announces Run For Los Banos City Council

Long time Los Banos resident John Cates announced today that he is seeking election to the City Council in the open District 3 seat. Incumbent Scott Silveira vacated the seat to run for the Merced County Board of Supervisors in the June Primary Election.

“I have devoted time and energy to many local civic projects during my 29 years of living here in Los Banos,” Cates said. “I view the City Council as a continuation of that community service. This is my chosen home, and I am glad I made that choice as the place to live and raise my family.”

Cates, who has worked at Hewlett Packard for 38 years, also owns and operates a small local business.

“My vision for the future of Los Banos centers on two things,” he said. “One is sensible, long term strategic planning that will maintain our excellent qualify of life here. That is why I chose eight years ago to serve on the city Planning Commission. The other part of my vision is solid economic development. A key component of that will be to encourage Silicon Valley firms to expand and relocate here. With my connections and history of working on the other side of the hill, I am uniquely positioned to successfully pursue that economic development goal.”

Cates has served on the Los Banos Planning Commission since 2012, currently serving as Chairman. He is a board member of the Los Banos Arts Council, and a member of the Measure V Citizens’ Oversight Committee.
